Long Term Disability Benefits under ERISA
Long-term disability benefits are generally paid to employees as a result of disability covered by a policy between the employer and an insurance company, although some companies are self-insured. The standards for disability can vary and are based on the policy negotiated by the employer and the insurance company and may contain several critical clauses for the individual, a common one being an offset of Social Security Disability benefits.
The time frames for appeal and submission of evidence can be very rapid and rigid, early involvement of legal representation is highly advised.
